GENERAL TERMS AND CONDITIONS AND CUSTOMER INFORMATION
I. GENERAL TERMS AND CONDITIONS
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as the supplier (Beckflip GmbH) via the website www.armwunder.de or by other means of distance communication. Unless otherwise agreed, we reject the inclusion of any terms and conditions of your own that you may use.
(2) A consumer within the meaning of the following provisions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
A trader is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Formation of the Contract
(1) The subject matter of the contract is the sale of goods.
(2) By listing the respective product on our website, we make a binding offer to conclude a contract through the online shopping basket system under the conditions stated in the product description.
(3) The contract is concluded through the online shopping basket system as follows:
The goods you intend to purchase are placed in the “shopping basket”. You can access the shopping basket using the corresponding button in the navigation bar and make changes there at any time.
After opening the “checkout” page, you enter your personal details and select the payment and shipping conditions. Your order details are then displayed in an order overview.
If you use an instant payment system as your method of payment, such as PayPal, PayPal Express or Amazon Pay, you will either be taken to the order overview page in our online shop or redirected to the website of the respective payment service provider.
If you are redirected to the respective payment service provider, you make the required selections or enter your details there. Your order details will then be displayed on the payment service provider’s website or after you have been redirected back to our online shop.
Before submitting your order, you can review and amend the information shown in the order overview, including by using the “back” function of your web browser, or cancel the purchase.
By submitting the order using the appropriately labelled button, you declare your legally binding acceptance of the offer, thereby concluding the contract.
(4) Any request you make for us to prepare an offer is non-binding for you. We will provide you with a binding offer in text form, for example by email, which you may accept within five days unless a different acceptance period is stated in the respective offer.
(5) Order processing and the transmission of all information required in connection with the conclusion of the contract are carried out by email and are partly automated.
You must therefore ensure that the email address you provide to us is correct, that you are technically able to receive emails and, in particular, that their receipt is not prevented by spam filters.
§ 3 Contract
(1) By purchasing goods through the online shop, you enter into a binding purchase contract.
§ 4 Right of Retention and Retention of Title
(1) You may exercise a right of retention only insofar as it relates to claims arising from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 5 Statutory Rights in the Event of Defects
(1) The statutory rights relating to liability for defects apply.
(2) If you are a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify us and the carrier of any complaints as soon as possible.
Failure to do so will not affect your statutory rights relating to defects.
§ 6 Applicable Law, Place of Performance and Jurisdiction
(1) German law applies.
For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) The place of performance for all services arising from the business relationship with us and the place of jurisdiction is our registered office if you are not a consumer but a merchant, a legal entity under public law or a special fund under public law.
The same applies if you do not have a general place of jurisdiction in Germany or the European Union, or if your place of residence or habitual residence is unknown at the time legal proceedings are commenced.
The right to bring proceedings before another court having jurisdiction under applicable law remains unaffected.
(3) The United Nations Convention on Contracts for the International Sale of Goods (CISG) expressly does not apply.

2. Information on the Formation of the Contract
The technical steps leading to the conclusion of the contract, the conclusion of the contract itself and the options available for correcting entries are governed by the provisions entitled “Formation of the Contract” in our General Terms and Conditions, Part I.
3. Contract Language and Storage of the Contract Text
3.1 The contract language is German.
3.2 We do not store the complete text of the contract.
Before submitting the order through the online shopping basket system, you can print the contractual information using your browser’s print function or save it electronically.
After we receive your order, the order details, the information required by law for distance contracts and the General Terms and Conditions will be sent to you again by email.
3.3 If you request an offer outside the online shopping basket system, you will receive all contractual information as part of a binding offer in text form, for example by email, which you can print or save electronically.
4. Essential Characteristics of the Goods and/or Scope of Services under Subscription Contracts
The essential characteristics of the goods and/or the scope of services under subscription contracts are stated in the respective offer.
5. Prices and Payment Conditions
5.1 The prices stated in the respective offers and the shipping costs are total prices. They include all price components and all applicable taxes.
5.2 Shipping costs are not included in the purchase price.
They can be viewed using an appropriately labelled button on our website or in the respective offer, are shown separately during the ordering process and must be paid by you in addition to the purchase price unless free shipping has been expressly offered.
5.3 If goods are delivered to countries outside the European Union, additional costs may arise for which we are not responsible, such as customs duties, taxes or money transfer charges, including bank transfer or exchange-rate fees charged by financial institutions. These costs must be borne by you.
5.4 You must also bear any money transfer charges, including bank transfer or exchange-rate fees charged by financial institutions, where delivery is made to an EU Member State but payment is initiated from outside the European Union.
5.5 The payment methods available to you are shown using an appropriately labelled button on our website or in the respective offer.
5.6 Unless otherwise stated for the respective payment method, payments arising from the concluded contract are due immediately.
6. Delivery Conditions
6.1 The delivery conditions, delivery date and any applicable delivery restrictions are stated using an appropriately labelled button on our website or in the respective offer.
6.2 If you are a consumer, the risk of accidental loss of or accidental damage to the goods during shipment passes to you only when the goods are handed over to you, irrespective of whether the shipment is insured or uninsured.
This does not apply if you independently commission a transport company that was not designated by us or another person appointed to carry out the shipment.
7. Statutory Rights in the Event of Defects
Liability for defects is governed by the provisions entitled “Statutory Rights in the Event of Defects” in our General Terms and Conditions, Part I.
